Be careful that you don't lose&lt;br /&gt;&lt;div&gt;your SOS and ad valorem property tax cap that is part of the Florida Constitution. This applies to real estate that is owned and used as a homestead. &amp;nbsp;Property rented for more than 6 months in two consecutive years is then presumed to be used for commerical purposes and you will lose your homestead exemption and cap that will cause your property taxes to go up. You might want to do a quick check of your home for the following:&lt;br /&gt;&lt;br /&gt;1. Check any exposed ducts-Make sure they are clean, no holes, and all joined and duct taped correctly.&lt;br /&gt;2. Look for insulation stains - Often this can be a sign of air leaks, from a hole or crack&lt;br /&gt;3. Make sure your insulation is thick enough, that is the R value.&lt;br /&gt;4. "As lenders adopt new federal guidelines, short sales should become less frustrating. The Home Affordable Foreclosure Alternative Program provides short sales guidelines for loans not owned or guaranteed by Fannie Mae or Freddie Mac (these agencies are expected to release their own&lt;br /&gt;guidelines). The following must be met:&lt;br /&gt;&lt;br /&gt;1. The property is the borrower's principal residence.&lt;br /&gt;2. The mortgage loan is a first lien mortgage, originated on or before January 1, 2009.&lt;br /&gt;3. The mortgage is delinquent or default is reasonably foreseeable.&lt;br /&gt;4. The current unpaid principal balance is equal to or less than $729,750.&lt;br /&gt;5. It might be helpful to you if you are due to close on your real estate purchase.&lt;br /&gt;These new rules took effect July 30, 2009.&lt;br /&gt;"1. The new requirements apply to all mortgages secured by a borrower's home, including&lt;br /&gt;      primary and secondary homes and refinancings. Investor loans continue to be exempt.&lt;br /&gt; 2. A lender must give a good faith estimate of mortgage loan costs within three business days&lt;br /&gt;     after the consumer applied for the loan.&lt;br /&gt; 3.The lender may not collect any fees before the disclosure is provided, except for a reasonable &lt;br /&gt;    fee for obtaining a credit report.&lt;br /&gt; 4.The closing may not take place until expiration of a seven day waiting period after the&lt;br /&gt;    consumer received the early disclosure.&lt;br /&gt;5. However, the values of the homes did go down a little.  To me this is good news, maybe this is the turn around everyone has been waiting for.  This is the 5th straight month that there have been sales ahead of last year in Florida. I know that I monitor the pending and closed on a weekly basis in MLS for certain MLS areas and have noticed there are a few more pendings and closings taking place. I have been reading numerous articles about the real estate industry and the New Year, and I must say that my head is spinning.  Some say the industry will start to turn and others keep the doom and gloom coming.  My feeling is that if you are comfortable with your life and would like to get or upgrade your present home or real estate portfolio, then go for it.  All of the articles have said that now is the time to get good opportunities for real estate purchases, and I will have to agree.  I monitor the MLS in my area and must say that I really have seen price drops, and quite a few foreclosures and pre-foreclosures, but to find them and be satisfied you need to do some homework.  First and foremost, you need to know the area that is of interest to you.  Drive around, talk to a realtor, look at the newspapers, go online, there is a wealth of information for you. Second, talk to different lenders and get an idea of what you can afford. Three, make sure that your credit is ok, use the free web site to check it out. Then  start looking at properties. If you have time (plenty of it), and you would like to try a "short sale", make sure you check to see that all of the parties that will be involved, are experts in this unique sales tool.  It takes a long time, can be very confusing, but can also be a rewarding way to buy.&lt;br /&gt;Buyers are in the "cat bird seat" now and there is alot of information, inventory, and help waiting for you. So it appears that as of now, we will not be voting on Amendment 5 and only Amendment 1 will reduce our property taxes. The way I understand it is that the school portion of the property taxes will be reduced on our tax bills and the money made up by increasing the sales tax.  Read up on it before going to the polls so that you understand it. Here are a few highlights that I personally find important:&lt;br /&gt;&lt;br /&gt;1. Doubling of the present homestead exemption from $25,000 to $50,000 for homes valued above $50,000.&lt;br /&gt;2. Save Our Homes Portability in that you can transfer the accumulated Save Our Homes benefit (up to $500,000) to a new homestead within 2 years of giving up your previous homestead.&lt;br /&gt;3. $25,000 tangible personal property tax exemption for businesses.&lt;br /&gt;4. Assessment cap of 10% for non-homesteaded property.&lt;br /&gt;&lt;br /&gt;Before voting, everyone should sit down for a few minutes and read all of the Amendment to make sure they understand how it will work for them. This would help to somewhat increase the State of Florida coffers.  However, the Legislature has filed suit and is saying that they should have been involved in the agreement and had a say in how it was written etc.  The State says that there is no where, where the State has to have the Legislature involved.  Here we go again with lawsuits. From people that I have talked to they are split. Some say "something is better than nothing" and others say it was a joke as it will only save the average homeowner between $200 and $400 per year.  My feeling and it is strictly my feeling is that we have to vote yes for it just to get a reduction in taxes started, then they can fine tune it and make it better as time goes by. They still have not come up with any remedies to help people out. The vote is to have the tax issues voted on by the public in November. We will see just what gets passed, but at least they are aware of the seriousness of the property tax problems and are willing to do something about them.
