A program called "The Dream Maker" through the Pentagon Federal Credit Union Foundation offers grants( up to $5,000) for home down payments to eligible military personnel who are first-time homebuyers. The grants can be applied to a mortgage from any financial institution. Google the

Summer Is Over

Well summer is now over and everyone is settling down for the winter months. Kids have gone back to school and now is the time to reevaluate your living priorities so that you are ready if that certain piece of property peeks your interest and tempts you to make a move. Especially when spring comes and maybe a new job is in order. You will be way ahead of the game, by getting your finances in order, knowing how much you can afford, and most important where you want to be. If you are to busy, this can all be done from the warm comfort of your home, and perhaps making a few phone calls. Have a real estate agent send you listings from the area that you might want to be in. That way you are keeping up with the listings and sales and can have a good financial picture for the neighborhood. Talk to a lending institution to see what types of programs are available. The market will turn and when it does, be ready.

Most people believe that going thru a foreclosure and short sale forgiveness of debt, that there will be no taxable income for the forgiveness difference. This is NOT true. Craigslist Scammers-Be Carefull

You can file a complaint with the Internet Crime Complaint Center (ic3.gov) if you feel you have been scammed on the Internet. Right now scam artists are targeting rental property listings. In the scam the criminals fraudulently lift legitimate rental property data from listings, change the contact phone numbers and or email addresses, and advertise the rental on craigslist. Everyone should be aware of this scam, not just Realtors but anyone who advertises property on Craigslist. Be aware of how you write and handle any advertising on the Internet, you do not know who will be reading it.

With Regard to IRS is Short Sale or Foreclosure Better

This is taken directly from the Florida Realtor Magazine, August 2010 issue - " There is no doubt that a foreclosure will have a detrimental effect on credit, but the negative impact on credit from a short sales may not be much less. Additionally, a short sale may not be in the seller's best interest, particularly if it's on an investment property and not the seller's principal residence. The IRS considers forgiveness of debt a taxable event under the Internal Revenue Code and therefore any mortgage amount forgiven on a non-principal residence property is taxed as income. In a foreclosure, there's no forgiveness of debt and therefore no taxable income."
Before you decide to do either a short sale or a foreclosure, you should contact an accountant and a real estate attorney to be sure what your best options are, so that you are protected as best as possible in this very difficult of times.

Be Careful When Renting

Since it has become very hard to sell a home, people are turning to renting. Be careful that you don't lose

your SOS and ad valorem property tax cap that is part of the Florida Constitution. This applies to real estate that is owned and used as a homestead. Property rented for more than 6 months in two consecutive years is then presumed to be used for commerical purposes and you will lose your homestead exemption and cap that will cause your property taxes to go up. Be aware and check with your local taxing authority to get the clearly defined rules.

Some Spring Home Checks For Energy Efficiency

Now that spring is finally here. You might want to do a quick check of your home for the following:

1. Check any exposed ducts-Make sure they are clean, no holes, and all joined and duct taped correctly.
2. Look for insulation stains - Often this can be a sign of air leaks, from a hole or crack
3. Make sure your insulation is thick enough, that is the R value.
4. Check the exterior make sure there are no drafts from windows, doors, attic hatches or other areas that might need caulking.

Some New Short Sale Guidelines

This is taken directly from National Association of Realtors Magazine February 2010 edition. "As lenders adopt new federal guidelines, short sales should become less frustrating. The Home Affordable Foreclosure Alternative Program provides short sales guidelines for loans not owned or guaranteed by Fannie Mae or Freddie Mac (these agencies are expected to release their own
guidelines). The following must be met:

1. The property is the borrower's principal residence.
2. The mortgage loan is a first lien mortgage, originated on or before January 1, 2009.
3. The mortgage is delinquent or default is reasonably foreseeable.
4. The current unpaid principal balance is equal to or less than $729,750.
5. The borrowers total monthly mortgage payment exceeds 31 percent of the borrowers gross income."

At least there is something to go by and hopefully will help with the short sale/foreclosure backlog.

Truth in Lending Act

The following updated information is taken directly from The Florida Realtor Magazine of November 2009. It might be helpful to you if you are due to close on your real estate purchase.
These new rules took effect July 30, 2009.
"1. The new requirements apply to all mortgages secured by a borrower's home, including
primary and secondary homes and refinancings. Investor loans continue to be exempt.
2. A lender must give a good faith estimate of mortgage loan costs within three business days
after the consumer applied for the loan.
3.The lender may not collect any fees before the disclosure is provided, except for a reasonable
fee for obtaining a credit report.
4.The closing may not take place until expiration of a seven day waiting period after the
consumer received the early disclosure.
5. If the annual percentage rate (APR) increases by more than 0.125 percent, the lender must
provide a corrected disclosure to the borrower and wait an additional three business days
before closing the loan.
6.The APR includes not only the interest rate but also certain other costs related to settlement
so it will be important for any fees that affect the APR to be as accuarate as possible and
provided as early as possible, to minimize the need for a corrected TILA disclosure.
7.The consumer may modify or waive both waiting periods for a documented personal
financial emergency, but must receive the disclosures no later than the time of the
modification or waiver."

The one statistic from the Pinellas Realtor Board for the month of July shows that the absorption rate on listings was 11.1%. Which shows that buyers are not just showing up but are buying. If you have been waiting for the "bottom", by all reports, we have reached it. If you are a first time buyer there are good programs out there for you. Mortgage rates are still down in the low 5's. $8000.00 first-time homebuyers tax credit will be able to apply for downpayment assistance through the State of Florida before they close on the purchase of their home, and then repay the amount borrowed when they get their tax refund. Buyers have through November 30 2009, to find a home, secure financing and close the transaction to be eligible for the federal $8000.00 tax credit/downpayment assistance."

Hurricane Season is Here

Well if you live anywhere in the Gulf areas or Atlantic, you know that June 1st starts the Hurricane season. You need to be sure to get your "hurricane kit" together and be ready to evacuate at a moments notice. My husband and I lived on the "barrier island" in Clearwater during the 2004 Hurricane season and had to evacuate 4 times, all on the weekends. To say these were stressful times is putting it mildly. We had our plastic containers ready to go, so all we had to do is pack up our cars and leave. Many TV stations and major home repair stores have the basic list of items that you need to take with you. Grab one and fill your containers and be ready. You are the only one to take care of yourself, no one else is there or will be there for you.

Interesting Statistic From MLS

Well another month has gone by and there are some signs that the market might be changing for the "good". Here are some quotes directly from the Pinellas Realtor Organization .

"Units Sold - There is definitely an upward trend in units sold, especially for single family homes. Single family unit sales were up 19.3% year over year in March and condo sales showed a 17% increase over March of last year. It still early to say this will hold."

"Inventory - the number of listings on the market continue to drop."

I personally feel better about the market, and finally see a "little" light at the end of the tunnel.

Homes ARE Selling!!!

Just listened to the local TV station and they said that there were homes that have sold in both Hillsborough and Pinellas counties, up from last year. However, the values of the homes did go down a little. To me this is good news, maybe this is the turn around everyone has been waiting for. This is the 5th straight month that there have been sales ahead of last year in Florida. I know that I monitor the pending and closed on a weekly basis in MLS for certain MLS areas and have noticed there are a few more pendings and closings taking place. This is GOOD!

Let us hope that 2009 will be a healthy and prosperous New Year for everyone! I have been reading numerous articles about the real estate industry and the New Year, and I must say that my head is spinning. Some say the industry will start to turn and others keep the doom and gloom coming. My feeling is that if you are comfortable with your life and would like to get or upgrade your present home or real estate portfolio, then go for it. All of the articles have said that now is the time to get good opportunities for real estate purchases, and I will have to agree. I monitor the MLS in my area and must say that I really have seen price drops, and quite a few foreclosures and pre-foreclosures, but to find them and be satisfied you need to do some homework. First and foremost, you need to know the area that is of interest to you. Drive around, talk to a realtor, look at the newspapers, go online, there is a wealth of information for you. Second, talk to different lenders and get an idea of what you can afford. Three, make sure that your credit is ok, use the free web site to check it out. Then start looking at properties. If you have time (plenty of it), and you would like to try a "short sale", make sure you check to see that all of the parties that will be involved, are experts in this unique sales tool. It takes a long time, can be very confusing, but can also be a rewarding way to buy.
Buyers are in the "cat bird seat" now and there is alot of information, inventory, and help waiting for you. Take advantage of it.

Amendment 5 on Florida Property Taxes

As of yesterday, the Florida Supreme Court ruled to take Amendment 5 regarding property taxes, off of the upcoming November ballot. So it appears that as of now, we will not be voting on Amendment 5 and only Amendment 1 will reduce our property taxes. I am sure we have not heard the last of Amendment 5 or some variation thereof.

The State has been sued to take Amendment 5 off of the November ballot. It will be left on the ballot until the case is heard sometime in September. Then we will know if in fact we will be voting for it. Stayed tuned to see what transpires.

Just to make you aware, in November everyone in Florida will be voting for or against Amendment 5 dealing with the reduction of property taxes and an increase in the sales tax. The way I understand it is that the school portion of the property taxes will be reduced on our tax bills and the money made up by increasing the sales tax. Read up on it before going to the polls so that you understand it. November is only a few months away, so make sure you know what you are voting for.

Affordable Health Insurance in Florida

Few Highlights of Property Tax Reform Amendment

Voters in Florida will be going to the polls on January 29th to vote for among other items, the Property Tax Reform Amendment. Here are a few highlights that I personally find important:

1. Doubling of the present homestead exemption from $25,000 to $50,000 for homes valued above $50,000.
2. Save Our Homes Portability in that you can transfer the accumulated Save Our Homes benefit (up to $500,000) to a new homestead within 2 years of giving up your previous homestead.
3. $25,000 tangible personal property tax exemption for businesses.
4. Assessment cap of 10% for non-homesteaded property.

Before voting, everyone should sit down for a few minutes and read all of the Amendment to make sure they understand how it will work for them. I am giving you an idea of how I interpret the different aspects relating to the Amendment.

HOWEVER YOU FEEL, JUST GET OUT AND VOTE IN JANUARY.

Governor Signed Agreement With Seminole Indians

This week Governor Charlie Crist signed an agreement with the Seminole Indians to let them increase their gambling games and types and the State of Florida would receive substantial revenues back. This would help to somewhat increase the State of Florida coffers. However, the Legislature has filed suit and is saying that they should have been involved in the agreement and had a say in how it was written etc. The State says that there is no where, where the State has to have the Legislature involved. Here we go again with lawsuits. Lets see where this ends up!

Legislature Passed New Property Tax Law

The Legislature passed the new property tax law and now it is up to the voters to vote for it or not in the January 29 election. From people that I have talked to they are split. Some say "something is better than nothing" and others say it was a joke as it will only save the average homeowner between $200 and $400 per year. My feeling and it is strictly my feeling is that we have to vote yes for it just to get a reduction in taxes started, then they can fine tune it and make it better as time goes by. Now it will be interesting to see how the voters will go.

Looks like Trump Tower Tampa, Florida is a no go. Both side have now filed lawsuits, with 2 of the partners filing against Donald Trump this week claiming he went against the confidentiality rules. The developer said that they would have known whether they could continue on with trying to secure financing by yesterday. Well it has come and gone and no answers as to the true outcome of this development. It would have been a great addition to the Tampa skyline, but with the market the way it is, many do not see it happening.

Florida Legislature Agrees

The Florida Legislature voted yesterday to the biggest property tax cut in the State history. They are rolling back and capping local and government spending and asking voters to supersize homeowner tax exemption. This will go before the voters on the January 29, 2008 ballot. The current session of the Florida Legislature has run into a solid brick wall regarding the Property Tax problem we have in this State. They still have not come up with any remedies to help people out. Finally a Light at the End of the Tunnel for Property Taxes

Yesterday, Wednesday April 18 the Florida Legislature voted to roll back the property taxes, and to phase in the increase in sales tax, among other proposals. The vote is to have the tax issues voted on by the public in November. We will see just what gets passed, but at least they are aware of the seriousness of the property tax problems and are willing to do something about them. Stay tuned throughout the rest of the year to see what the outcome will be. Florida is still a great place to call home.
